1. Introduction

 

1.1 Welcome

 

Welcome to Hospoto ("the platform," "we," "our," or "us"), operated by Hospoto (ABN 18 814 083 532). Hospoto ("Hospoto.com.au") owns and operates www.hospoto.com.au and its associated subsidiaries. These Terms and Conditions ("Terms") govern your use of our mobile application and website (collectively, the “services”), including all features and services provided through them. We provide an online platform that enables:

 

  1. Working Holiday Visa holders in Australia (“job seekers”) to:
    1. View hospitality job opportunities in remote areas, including those that satisfy
    2. Send resumes and other documents required for employment to hospitality

a)  View hospitality job opportunities in remote areas, including those that satisfy

‘specific work’ visa requirements,

b)  Send resumes and other documents required for employment to hospitality

businesses seeking employment,

c)  Track 88 days of specific work, and

d)  Upload timesheets and payslips.

2)  Hospitality businesses (“employers”, or “business users”) to:

a)  Indicate whether they are looking for new employees or not, and

b)  Receive resumes and other documents required for employment from job

seekers.

When you access, register for, or use the services, you accept and agree to follow these Terms. 1.2 Changes

We may update these Terms (including our features and services) at our discretion and without notice. We recommend reviewing these Terms before each use of our platform to stay informed about the current rules and policies governing your use of our services.

Our platform undergoes regular updates to reflect changes in our services, user requirements, and business priorities. As such, the information displayed may not always be current or complete at the time of viewing. We cannot guarantee continuous or uninterrupted access to our platform, nor can we ensure it is free from viruses or other potentially harmful elements that might affect your devices. For business or operational reasons, we may need to temporarily

suspend, withdraw, or restrict access to our platform or certain features. When possible, we will provide reasonable advance notice of such disruptions. If others access our platform through your internet connection, you are responsible for ensuring they are aware of and comply with these Terms and any other applicable policies.

1.3 Eligibility

This platform is intended for users over the age of 18, who are current or prospective Working Holiday Visa (subclass 417 and 462) holders, or those in charge of hiring at hospitality businesses. Please do not upload content if you are under age.

2. Definitions

Key terms used in these Terms and Conditions:

"Content" refers to job postings, company information, resumes, user profiles, graphics, photos, location information and any other materials uploaded to the platform, by job seekers or employers.

"Business User", or “Employer” means any entity that posts job opportunities on the platform.

"Job Seeker" means any individual who uses the platform to view job opportunities and submit applications.

“Users” means collective of both parties, business users and job seekers.

"Services" means all features and functionalities provided through the platform, including mobile and web applications.

"Intellectual Property Rights" includes all copyrights, patents, trademarks, designs, and other legal rights (both statutory and common law) that protect business or personal reputation.

"Personal Information" means any information about an identified or identifiable individual, and carries the same meaning as defined in the Privacy Act 1988 (Commonwealth of Australia).

3. Accounts

3.1 Registration Business Users must:

a)  Provide accurate, current, and complete information,

b)  Be at least 18 years old to register,

c)  Have business legitimacy assessed before using our services,

d)  Maintain and update their information,

e)  Ensure they have authority to represent their business,

f)  Keep login credentials secure and confidential,

g)  Remain responsible for all activity that occurs on their account, and

h)  Notify us immediately if they suspect any unauthorized access to their account.

Job Seekers must:

a)  Create an account to view content and use our features,

b)  Be at least 18 years old to register,

c)  Undergo email account verification before using our services,

d)  Warrant that all information provided during registration is accurate and true,

e)  Agree to promptly notify us of any changes to account information, by updating their

profile within the platform,

f)  Not share accounts. Each account is for single person use only,

g)  Remain responsible for all activity that occurs on their account,

h)  Keep their account secure and confidential, including password and login details, and

i)  Notify us immediately if they suspect any unauthorized access to their account.

3.2 Security Checks

For your safety, we conduct security checks on all user accounts. By using our platform, you understand and agree that these checks may take place before your account becomes active.

All accounts are verified via email before having access to our services. 3.3 Termination
We reserve the right to suspend or terminate your account if:

●  You breach or violate any of the Terms,

●  We believe your use of the service could damage Hospoto.com.au’s reputation or cause

us to break any laws, and

●  We have reasonable grounds to believe your use of the service poses a risk to the

health, safety, or wellbeing of other users or community members.
You will not be compensated if your account is suspended or terminated for any reason above.

4. Services

4.1 Use as a tool

Our platform is provided solely as a tool to facilitate connecting travelers seeking employment with potential employers. Users acknowledge that they utilize our services entirely at their own risk and discretion. The platform serves merely as an intermediary connection service, and we assume no liability for any consequences resulting from relationships formed through our platform, the accuracy of information provided by other users, or the outcomes of any employment or visa application processes. By using our services, you acknowledge that you

retain complete responsibility for all decisions and actions taken based on information accessed through our platform.

4.2 Access to our platform

While we aim to provide continuous access to our platform and services 24/7, there may be times when access is unavailable due to:

●  Regular maintenance and improvements,

●  Circumstances beyond our control, such as internet outages or hosting issues, and

●  System updates and repairs.

During these periods of unavailability, we will not be liable for any disruption to your access or use of our services, regardless of the cause.

4.3 No Advice

We provide general information on our platform about moving abroad, travel recommendations, life in Australia, and employment/employee seeking tips, including articles about eligibility for visa extension. However:

●  This content is for general information only and is not personalized advice,

●  It does not take into account your specific situation, finances, or needs,

●  You should seek professional legal, property, accounting, or other advice for your

particular circumstances, and

●  Do not use our informational content as the sole basis for making legal decisions,

negotiations, agreements, or financial commitments.

4.4 No Job Guarantee

While the platform provides valuable tools and resources to connect job seekers with potential work opportunities and facilitate visa extensions, it is important to understand that using our platform does not guarantee employment or visa approval. The platform is a tool connecting travelers and potential employers, offering information, application assistance, and networking capabilities, rather than a job gaurentee. Success ultimately depends on many factors outside our control, including but not limited to: your qualifications and experience, employer hiring needs, current immigration policies, visa quotas, and local economic conditions. Users should understand the services are a helpful resource in their job search and visa extension process, not an assured pathway to employment. We strongly encourage users to conduct their own research, carefully evaluate opportunities, and comply with all relevant immigration and employment laws in their target destinations.

4.5 No Legal

Our platform explicitly does not provide legal advice or legal services of any kind. All information presented through the platform regarding visa requirements, work permits, immigration policies,

or employment regulations is for general informational purposes only and should not be construed as legal counsel. The services, including document checklists, application timelines, and visa requirement summaries, are designed as organizational tools to help users navigate processes, not as substitutes for professional legal guidance. Users are solely responsible for ensuring their compliance with all applicable laws and regulations in both their home country and destination country. We strongly recommend consulting with qualified immigration attorneys, legal professionals, or official government sources for specific legal advice regarding your individual circumstances. By using the platform, you acknowledge that you understand this limitation and agree not to rely on the app's content as legal advice.

5. Job Seeker Responsibilities

5.1 User good practice guidelines

Here are some tips for successful use of the platform, optimizing your chances to find work, track you 88 days, and secure a second year Working Holiday Visa:

a)  Upload a professional profile photo and maintain an updated resume,

b)  Enable notification alerts to be promptly informed of new job vacancies or requests from

business users,

c)  Use the map feature to browse job vacancies all over the country,

d)  Log eligible work hours on the platform promptly after each shift to ensure calculator is

kept up to date,

e)  Use the platform's resources such as skills assessments and career advice articles to

strengthen your candidacy, and

f)  Provide feedback to us as soon as a bug is encountered, or if there are features that

need upgrading/changed to better suit your needs. We are here to help and share the love of exploration in Australia’s remote landscapes.

5.2 Use of Mobile Application

Job seekers using our platform bear several important responsibilities to ensure a fair, effective, and compliant platform experience. All users must:

a)  Provide accurate, truthful, and up-to-date personal information, work history, qualifications, and visa status, updating this information promptly when changes occur,

b)  Use the platform's resources responsibly, submitting applications only for positions they are genuinely qualified for and interested in pursuing,

c)  Thoroughly research potential employers and positions,

d)  Understand the visa requirements as a Working Holiday Maker,

e)  Comply with all applicable immigration and employment laws in both their home and

destination countries, maintaining valid documentation throughout the job application

and employment process,

f)  Engage in professional and respectful communication with potential employers,

g)  Maintain the confidentiality of any sensitive information shared by employers during the application process, and

h)  Report any suspicious activities, potential scams, or policy violations they encounter while using the platform.

5.3 Compliance with local immigration laws

Job seekers on our platform acknowledge and accept full personal responsibility for complying with all applicable immigration laws, regulations, and requirements in both their home country and intended destination country. This includes, but is not limited to, obtaining proper work authorization, adhering to visa conditions and restrictions, respecting permitted work hours, not engaging in unauthorized employment, and maintaining valid documentation at all times. The user bears sole responsibility for ensuring that any employment arrangement facilitated through our platform aligns with their current immigration status and work rights. Our platform does not guarantee the legality of any job opportunity for your specific circumstances, nor does it assume responsibility for any immigration violations, penalties, deportation proceedings, or future immigration consequences that may result from employment decisions. Users agree to indemnify and hold harmless our platform from any claims arising from their non-compliance with immigration laws

5.4 Prohibited activities

Job seekers are strictly prohibited from engaging in any activities that undermine the integrity and security of our platform. These prohibited activities include, but are not limited to:

a)  Providing false or misleading information in profiles or applications,

b)  Impersonate any person or entity, or use false/unauthorized names,

c)  Capture or copy any content on the platform for any reason (temporary copies sent to

our support team, to aid with a technical issue, excepted),

d)  Sharing account credentials with other individuals,

e)  Uploading fraudulent identification documents or work credentials,

f)  Using the services to harm, or attempt harm, other users, or disrupting other users ability

to use the services,

g)  Using automated scripts or bots to interact with the platform,

h)  Engaging in any form of visa or immigration fraud,

i)  Publishing defamatory content about employers or the platform,

j)  Gather user lists or data through unauthorized means, and without consent,

k)  Use the services to create or send unsolicited advertising or unauthorized

communications to other users,

l)  Using the platform to facilitate any illegal activities including work permit violations or

unauthorized employment,

m)  Introduce any viruses, malware, or any harmful programs designed to disrupt or interfere

with the normal operations of the platform,

n)  Reverse engineer, modify, decompile, disassemble, tamper with, or otherwise uncover

the source code of any software forming the platform, and 

o) Disrupt our relationships with internet service providers or suppliers.

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of any pending applications, and potential reporting to relevant authorities where legally required. Refer to section 3.3 regarding termination, no compensation will be given.

6. Business User Responsibilities

6.1 Job posting and communication guidelines

In order to keep the platform functioning at an optimal state we greatly appreciate co-operation and feedback from business users. We have included these guidelines to help employers get the most out of our services:

a)  Promptly update your “hiring status” on the platform to accurately reflect operation needs.

i)  Turn on - only when actively seeking employees,

ii)  Turn off - as soon as the positions have been filled,

iii)  Job seekers will be notified when your status changes.

b)  If you are suspecting a need to hire again (for example, high season is about to begin),

turn your status on proactively, to notify job seekers,

c)  Browse resumes online, do not accept paper copies. Encourage travellers to download

our platform and apply that way,

d)  Only request for personal documents after reviewing and deciding that an applicant is a

good fit for the role,

e)  Call the applicant if you’d like to set up a time to meet or trial shift before requesting for

more personal documents (such as visa grant, bank details, proof of RSA, etc.).

6.2 Use of Web Application

Business owners utilizing our platform to seek employees must uphold specific responsibilities to maintain platform integrity and legal compliance. Employers are required to:

a)  Provide accurate and complete business information, including valid business registration details, and legitimate contact information,

b)  Comply with all applicable labor laws, minimum wage requirements, and anti-discrimination regulations in their jurisdiction throughout the hiring process,

c)  Verify ability to legally employ foreign workers before extending offers,

d)  Maintain the confidentiality of any sensitive information shared by employees during the

application process, and

e)  Engage in professional and respectful communication with potential candidates found on

the platform, even when communications transitioned elsewhere.

Business owners acknowledge that our platform serves solely as a connection tool and that they bear full responsibility for all employment decisions, verification of candidate qualifications, and compliance with governmental authorities.

6.3 Compliance with labor laws

Business owners must comply with all applicable labor laws and regulations throughout the entire hiring and employment process. This includes adherence to fair wage practices, working hours, workplace safety standards, anti-discrimination laws, hiring foreign workers, and proper worker classification. Our platform functions solely as a connection tool and does not assume any employer legal responsibilities or liabilities. Business owners remain fully responsible for work eligibility verification, equal opportunity practices, lawful interviewing, and compliant employment agreements. By using our platform, Business owners confirm their familiarity with relevant employment laws in all applicable jurisdictions and accept full responsibility for compliance, understanding that violations may result in platform removal and potential regulatory consequences.

6.4 Prohibited activities
Business owners are prohibited from using our platform to:

a)  Engage in exploitative or deceptive practices,

b)  Circumvent proper work authorization processes by encouraging job seekers to

misrepresent visa status,

c)  Attempt to avoid standard employment taxes or benefits by misclassifying employees as

independent contractors,

d)  Recruit workers with false promises of visa sponsorship or permanent residency,

e)  Facilitate payment below legal minimum wage standards,

f)  Request or accept payments from job seekers,

g)  Collect excessive personal information from applicants beyond what's reasonably

necessary for hiring decisions,

h)  Discriminate against applicants based on protected characteristics,

i)  Attempt to bypass platform fees (if applicable) by moving communications off-platform

prematurely; or soliciting payment from job seekers for employment opportunities,

j)  Hack or do anything which may compromise the platform security,

k)  Impersonate any person or entity, or use false/unauthorized names,

l)  Sharing account credentials with unauthorized individuals,

m)  Publishing defamatory content about employers or the platform,

n)  Gather user lists or data through unauthorized means, and without consent, and

o)  Use the services to create or send unsolicited advertising or unauthorized

communications to other users.

Any detected attempts to use our platform for such activities may result in immediate account suspension or termination, and reporting to relevant authorities where applicable.

7. Content

7.1 Uploading of Content

When you create a profile, as a job seeker, you are encouraged to upload content (such as photos, resume, certifications, contact and other information) to maximize the functionality of the platform, so that business users can view. Business users are encouraged to keep contacts, and other information, up to date. By uploading any content, you confirm that you accept and agree to follow these Terms.

All users who upload content are solely responsible for ensuring their content complies with these Terms. Hospoto.com.au does not review or approve any content posted on the platform and is not responsible for doing so.

7.2 Rights to the Content
When you upload any content, you confirm that:

You own everything in the content, including all intellectual property rights. If you don't own it, you have gotten proper permission from whoever does.

If there are any people shown in your content, you have their permission to:

Include them in the content,

Upload the content to the platform, and

Give Hospoto.com.au the rights mentioned in these Terms.

Nothing in your content violates anyone else's rights, including their intellectual property rights.

Your content doesn't contain anything that is: ● Offensive

● Defamatory
● Discriminatory ● Pornographic ● Abusive

7.3 No endorsement

Hospto.com.au does not take responsibility for:

●  Any content that users upload to our app or web app, and

●  Any opinions, recommendations, or advice expressed in these posts.

7.4 Ownership

When you submit content to our website, Hospoto.com.au recognizes that you keep ownership of your content. We have no rights to your content except for those specifically granted in these Terms or in other written agreements with you.

7.5 Licence

When you upload content, you hereby grant Hospoto.com.au a worldwide, perpetual, irrevocable, non-exclusive, and royalty-free license to utilize your content in any manner on our platform. This license permits Hospoto.com.au to host, store, maintain, reproduce,

communicate, distribute, display, exhibit, perform, publish, broadcast, and transmit your content. Furthermore, Hospoto.com.au may modify, adapt, reformat, translate, and create derivative works from your content. This comprehensive license applies to all or any portion of your uploaded content and extends to any website associated with, connected to, or operated by Hospoto.com.au, including but not limited to websites owned and operated by other entities.

7.6 Modification or removal of Content

Hospoto.com.au has complete discretion to edit, modify, block, or remove any content on the platform if we determine they violate or are likely to violate our Terms.

8. Payment Terms

8.1 Fee structure

Our platform offers services available for subscription purchase. When you subscribe to any of our paid services, your subscription will continue automatically and your payment method will be charged according to your selected billing cycle until you actively cancel the subscription. You are responsible for maintaining accurate and current payment information and ensuring sufficient funds are available to process payments. Unsuccessful payments will result in account suspension or termination. We reserve the right to modify our pricing structure with reasonable notice to users

8.2 Payment methods

By using our services, you agree to pay all applicable fees as described within the app. All major credit and debit cards are accepted. Payment information provided by you will be stored securely by authorized payment processors in compliance with industry standards. All payments are in the currency of the region your App Store (iOs) or Google Play Store (Android) is connected to. Any currency conversion is not in our control, and by subscribing you accept we are not liable for this. It is the users responsibility for applicable taxes.

8.3 Refund Policy
All fees are non-refundable except where required by law.

For subscription services, cancellation before the renewal date will stop future charges, but we do not provide prorated refunds for the unused portion of your current billing cycle.

9. Data Privacy and Security

We take your privacy seriously. For complete details on how our platform and its partners collect, process, and protect your personal information, please review our Privacy Policy document. Your continued use of our services constitutes acceptance of our data handling practices as outlined in this policy. The Privacy Policy explains your rights regarding your personal information and how we safeguard your data while delivering our services.

10. Intellectual Property

10.1 App ownership

All intellectual property rights in the app, including but not limited to trademarks, logos, designs, text, graphics, images, software, code, algorithms, user interface, databases, and features ("App Content") are owned by us and are protected by copyright, trademark, and other intellectual property laws. You acknowledge and agree that you shall not acquire any ownership rights in any aspect of the App Content. Any unauthorized use of our intellectual property may violate applicable laws and may result in termination of your access to the platform and potential legal action.

10.2 User-generated content

By submitting, posting, or displaying content on or through our app ("User Content"), you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display such User Content in connection with the operation of our services. You represent and warrant that you own or have the necessary rights to all User Content you submit and that such User Content does not violate third-party rights. You retain ownership of your User Content, but acknowledge that we cannot control how other users might use publicly available User Content. We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate.

10.3 License to use content

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable use of our platform solely for your personal, non-commercial purposes. This does not permit you to modify, reproduce, distribute, create derivative works or adaptations of, publicly display, or in any way exploit any of the App Content without our prior written consent. You may not use any data mining, robots, scraping, or similar data gathering methods. Any use of the platform other than as specifically authorized herein is strictly prohibited and will automatically result in suspension or termination of use.

11. Third-Party Services

11.1 Links to external services

Our platform may contain links to external websites and resources operated by third parties, including advertisements and sponsored content. These links are provided for informational purposes only and do not constitute our endorsement or approval of these websites or their content. We have no control over external websites or their contents, and your access to and use of such sites is entirely at your own risk. All third-party websites operate under their own terms of use and privacy policies, which may differ significantly from ours, and your interactions with these sites are governed by their respective policies. If you wish to link to our platform or use any of our content elsewhere, you must do so in a fair and legal manner that does not damage our reputation, and must first obtain our written permission by contacting our team at partner@hospoto.com.au. Links to our platform must not suggest any association, approval, or

endorsement where none exists. We reserve the right to revoke linking permission at any time without prior notice.

12. Limitation of Liability

12.1 Service "as is" provision

You use our platform and services at your own risk. We provide them "as is" and make no promises or guarantees (to the extent allowed by law) about how they work, whether they will work properly, or whether they are free from defects.

To the maximum extent permitted by law, Hospoto.com.au hereby disclaims all liability (whether arising from contract, negligence, statutory obligations, or any other basis) for any direct or indirect losses or damages of any nature that you may suffer or incur. This disclaimer of liability encompasses all damages or losses arising from your use of the platform or services, as well as any dealings or interactions you may have with Hospoto.com.au. This comprehensive limitation of liability applies regardless of the form or basis of any potential legal claim.

12.2 Disclaimer for visa outcomes

Hospoto.com.au hereby disclaims all liability regarding visa grant outcomes by using our platform and services. This is inclusive of providing any advice or guarantee to satisfying the 88 day specific work requirements. We are here for reference, as a guide, or tool to assist only. Please refer to Australian Immigration Home Affairs for details on eligibility of WHM visa extension https://immi.homeaffairs.gov.au/what-we-do/whm-program/specified-work-conditions.

We are not held liable for any legal or immigration complications. We are not held liable for the outcome of your visa application.

12.3 Disclaimer for travel plans

Hospoto.com.au hereby disclaims all liability regarding travel planning and location relocation by using our platform and services. This includes, but not limited to, costs of flights, transportation, and accommodation incurred after finding employment through our services and deciding to move. We are here for reference, as a guide, or tool to assist only. We will not reimburse any travel costs if employment falls through after moving to a new city, for example.

12.4 Employment relationship disclaimers

Nothing in these Terms establishes an employment, agency, partnership, or joint venture relationship between users and Hospoto.com.au. Users of this app are independent parties and not employees, partners, or agents of Hospoto.com.au. No user shall have authority to bind us or make any representations or warranties on our behalf. By using the platform, you acknowledge that you are not entitled to any employment benefits, compensation, or protections and you agree that you are solely responsible for all tax obligations arising from any transactions conducted through the platform.

Users acknowledge that any relationships formed through our platform are established independently between users themselves. Our service solely functions as a connection tool, and we assume no responsibility or liability for any agreements, contracts, arrangements, or interactions that occur between users. Hospoto.com.au does not guarantee, supervise, or bear any legal responsibility for the conduct, quality of work, payment disputes, or any other aspects of relationships established through our platform. Users agree to hold the company harmless from any claims arising from their interactions with other users.

12.5 Force majeure clauses

In the event of a Force Majeure, defined as circumstances beyond our reasonable control including but not limited to natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government actions, strikes, power outages, internet or telecommunications failures, or other similar events, we shall be excused from performance of our obligations under these Terms for the duration of such event. We will make reasonable efforts to notify users of any such disruption and resume normal operations as soon as practicable. During such events, access to the platform services may be partially or completely suspended without liability to you or obligation for refund or compensation.

13. General

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales, Australia, in respect of any proceedings arising out of or in connection with these Terms.

13.2 Severability

If any provision of these Terms is void, voidable, unenforceable or illegal, that provision will be read down so as to be valid and enforceable or, alternatively, will be severed from these Terms. The severance of any provision in accordance with this clause will not affect the validity or effectiveness of the remaining provisions of these Terms.

13.4 Apple App Store and Google Play Store

By downloading and using this app from the Apple App Store or Google Play Store, you acknowledge and agree that these Terms are between you and Hospoto.com.au only, and not with Apple Inc. or Google LLC.
